1. Acceptance of Terms

By downloading, installing, or using TerminalX ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

TerminalX is developed and operated by MixxAI ("we", "us", or "our").

2. Description of Service

TerminalX is an SSH terminal application that provides:

  • SSH and SFTP connectivity to remote servers
  • Terminal emulation capabilities
  • AI-powered assistance for command generation and error analysis
  • Server monitoring features
  • Command snippet management

3. User Responsibilities

You are responsible for:

  • Maintaining the security of your device and credentials
  • All activities that occur under your account or through your use of the App
  • Ensuring you have proper authorization to access any servers you connect to
  • Complying with all applicable laws and regulations when using the App

3.1 Prohibited Uses

You agree not to use the App to:

  • Access systems or networks without authorization
  • Transmit malicious code or engage in hacking activities
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Interfere with or disrupt the App or servers connected through it

4. Subscriptions and Payments

4.1 Free Tier

The App offers a free tier with limited features including 2 saved connections and 10 AI queries per day.

4.2 Pro Subscription

The Pro subscription unlocks additional features and is available as:

  • Monthly subscription: $4.99/month
  • Yearly subscription: $39.99/year
  • Lifetime purchase: $99.99 (one-time payment)

4.3 Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

4.4 Managing Subscriptions

You can manage or cancel your subscription through your Apple ID account settings in the App Store.

4.5 Refunds

All purchases are processed through Apple's App Store. Refund requests must be made through Apple according to their refund policies.

5. AI Features

The App integrates with third-party AI services (OpenAI, Anthropic) to provide AI-powered features. By using these features:

  • You acknowledge that AI responses may not always be accurate
  • You agree to review AI-generated commands before execution
  • You understand that your queries may be processed by third-party AI providers
  • You accept responsibility for any actions taken based on AI suggestions

6. Intellectual Property

The App, including its code, design, logos, and content, is owned by MixxAI and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal or business purposes.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

You understand and agree that:

  • SSH connections involve inherent security risks
  • We are not responsible for the security of servers you connect to
  • Data transmitted through SSH connections is your responsibility

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIXXAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or profits
  • Unauthorized access to your servers or data
  • Service interruptions
  • Damages resulting from AI-suggested commands

10. Indemnification

You agree to indemnify and hold harmless MixxAI from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions.
